How to File a Consumer Complaint in India Online (And Actually Win)

India's Consumer Protection Act 2019 is one of the strongest consumer laws in the world. It covers defective products, service failures, misleading advertisements, and e-commerce fraud. Most people never use it — not because their case is weak, but because they don't know how easy it is to file.

Quick Answer: File at consumerhelpline.gov.in (INGRAM portal) or directly at your District Consumer Commission. Filing costs ₹50–₹200. You do not need a lawyer. The forum must dispose of your case within 90 days.

What the Law Says

The Consumer Protection Act, 2019 replaced the 1986 Act with significantly stronger protections:

  • Section 2(7): Definition of "consumer" — anyone who buys goods or hires services for personal use (not for resale or commercial purpose)
  • Section 34: District Consumer Commission has jurisdiction for claims up to ₹1 crore
  • Section 47: State Consumer Commission handles ₹1–10 crore claims
  • Section 58: National Consumer Disputes Redressal Commission (NCDRC) for above ₹10 crore
  • Section 38: Commission must try to dispose of the complaint within 90 days

Who Is a Consumer Under Indian Law

You are a consumer if you:

  • Bought goods or hired/availed services
  • For personal use (not for commercial resale)
  • Paid consideration (or even if you received it as a gift)

You are NOT a consumer if you bought goods/services for commercial resale or exclusively for business purposes.

E-commerce specifically: Buying from Amazon, Flipkart, Zomato, Swiggy, MakeMyTrip — all covered. The platform AND the seller can be made parties to the complaint.

Step-by-Step: Online Complaint via INGRAM

INGRAM = Integrated Grievance Redressal Mechanism File at: consumerhelpline.gov.in

  1. Register at the portal with your mobile number
  2. Select "Register Complaint"
  3. Choose the category: Product / Service / E-commerce / Utility
  4. Enter company/brand details
  5. Describe your complaint in detail (be specific about dates, amounts, what was promised vs. delivered)
  6. Upload evidence: invoice/receipt, product photos, communication screenshots, rejection emails
  7. Submit — you'll get a complaint number

The INGRAM system forwards your complaint to the company. The company has 30 days to respond. If unresolved, your complaint can be escalated to the Consumer Forum directly from the portal.

Step-by-Step: Filing at District Consumer Commission

If INGRAM doesn't resolve it, or for larger amounts, file directly at the District Consumer Commission.

Documents to prepare:

  • Complaint in writing (format below)
  • Copy of invoice/purchase proof
  • Evidence of defect or service failure (photos, screenshots, emails)
  • Copy of complaint sent to the company with proof of sending
  • Any warranty card or service agreement

Filing process:

  1. Draft your complaint clearly stating: who you are, what you bought, what was promised, what went wrong, what remedy you want
  2. Make 3 copies + copies for each opposite party
  3. File at the District Consumer Commission in the district where you bought the product/service
  4. Pay the filing fee (₹50 for claims under ₹1 lakh; ₹200 for ₹1–5 lakh)
  5. Receive the case number

Frequently Asked Questions

Do I need a lawyer to file a Consumer Forum complaint? No. The process is designed to be self-representable. Many successful complainants appear in person without a lawyer.

Can I file against an e-commerce platform or only the seller? Both. Under the 2019 Act, e-commerce platforms have explicit obligations. Amazon, Flipkart etc. can be made parties to the complaint.

What if the company is headquartered in a different city? You can file where you made the purchase or where you reside. This was specifically added in the 2019 Act to prevent companies from forcing consumers to travel to their HQ.

Is there a time limit to file? Yes — 2 years from the date the cause of action arises (i.e., from when you discovered the defect or service failure). File as soon as possible.

What if the company doesn't respond to the forum notice? The Commission will proceed ex-parte (in your absence) and can issue an order against the company even if they don't respond.

Can I claim for mental agony? Yes. Indian Consumer Forums routinely award compensation for mental agony and harassment — especially in cases involving insurance, banking, or real estate.
